Honduras: CIDH condena asesinato de mujer trans en Honduras‏

Washington, D.C. - La Comisión  Interamericana de Derechos Humanos (CIDH) condena el homicidio de Barbarita,mujer trans de 21 años de edad, en San Pedro Sula, Honduras.

De acuerdo con la información recibida, el 2 de agosto de2012, en una vía apartada de la colonia San Martín de San Pedro Sula, fuehallado el cuerpo sin vida de Barbarita (registrada al nacer como Marlon JavierJiménez Alemán) quien presentaba varios impactos por arma de fuego en su rostroy cabeza, y presentaba signos de haber sido atada de manos. Según medios decomunicación, sus familiares informaron que cuatro personas se habríanpresentado en su casa el día anterior, dijeron ser agentes de la DirecciónNacional de Investigación Criminal, y se la llevaron, indicando que estabadetenida.
La CIDH recuerda que es obligación del Estado investigarde oficio hechos de esta naturaleza y sancionar a las personas que resultenresponsables. La Comisión insta al Estado a abrir líneas de investigación quetengan en cuenta si este asesinato fue cometido en razón de la expresión degénero, la identidad de género o la orientación sexual de la víctima.
La Comisión continúa recibiendo información sobreasesinatos, torturas, detenciones arbitrarias y otras formas de violencia yexclusión contra lesbianas, gays y personas trans, bisexuales e intersex.Asimismo, la Comisión observa que con mucha frecuencia existen problemas en lainvestigación de estos crímenes, lo que conlleva, en parte, a que no se abranlíneas de investigación que tengan en cuenta si el delito fue cometido en razónde la expresión de género, identidad de género u orientación sexual de lasvíctimas. La inefectividad de la respuesta estatal fomenta altos índices deimpunidad, los cuales a su vez propician su repetición crónica, sumiendo a lasvíctimas y a sus familiares en la indefensión.
La CIDH urge al Estado a adoptar acciones para evitar yresponder ante estos abusos a los derechos humanos y garantizar que laspersonas LGTBI puedan ejercer efectivamente su derecho a una vida libre de discriminacióny violencia, incluyendo la adopción de políticas y campañas públicas, así comolas reformas necesarias para adecuar las leyes a los instrumentosinteramericanos en materia de derechos humanos.
La CIDH es un órgano principal y autónomo de la Organizaciónde los Estados Americanos (OEA), cuyo mandato surge de la Carta de la OEA y dela Convención Americana sobre Derechos Humanos. La Comisión Interamericanatiene el mandato de promover la observancia de los derechos humanos en laregión y actúa como órgano consultivo de la OEA en la materia. La CIDH estáintegrada por siete miembros independientes que son elegidos por la AsambleaGeneral de la OEA a título personal, y no representan sus países de origen oresidencia.

IACHR Condemns the Murder of a Trans Woman in Honduras

Washington D.C. - TheInter-American Commission on Human Rights (IACHR) condemns the murder of Barbarita,a 21-year-old trans woman, in San  Pedro Sula, Honduras.
According to the information received, on August 2, 2012, in aremote area in Colonia San Martín, San  Pedro Sula, the body of Barbarita (registered at birthas Marlon Javier Jiménez Alemán), was found with a series of bullet wounds toher face and head. Also, her hands showed signs of being tied behind her back.According to the media, her relatives reported that four persons came to theirhouse the day before, announcing they came as officers from the National Agencyof Criminal Investigation (Dirección Nacional de Investigación Criminal), andtook her, indicating she was arrested.
The IACHR reminds the State of its obligation to investigatesuch acts on its own initiative and to punish those responsible. TheInter-American Commission urges the State to conduct an investigation thattakes into account whether this murder was committed because of the genderexpression, gender identity or sexual orientation of the victim.
The Commission continues to receive information on killings,torture, arbitrary arrests, and other forms of violence and exclusion againstlesbians, gays, and trans, bisexual, and intersex persons. In addition, theCommission notes that very frequently, problems exist in the investigation ofthose crimes, which involve, in part, failures to open lines of investigationinto whether the crime was committed by reason of the victim's gender identityor sexual orientation. The ineffectiveness of the state response fosters high ratesof impunity, which in turn lead to the chronic repetition of such crimes,leaving the victims and their families defenseless.
The IACHR urges the State to take action to prevent and respondto these human rights abuses and to ensure that LGTBI people can effectivelyenjoy their right to a life free from discrimination and violence, includingthe adoption of policies and public campaigns and the amendments necessary tobring laws into line with the inter-American instruments on human rights.
A principal, autonomous body of the Organization of AmericanStates (OAS), the IACHR derives its mandate from the OAS Charter and theAmerican Convention on Human Rights. The Inter-American Commission has amandate to promote respect for human rights in the region and acts as aconsultative body to the OAS in this matter. The Commission is composed ofseven independent members who are elected in a personal capacity by the OASGeneral Assembly and who do not represent their countries of origin orresidence.
