Los Jueces del Tribunal de Sentencia de Trujillo, Freddy René
Caballero, Ricardo Rodríguez y Karen Yamileth Rodríguez, no admitieron
un recurso para revisión de medidas a favor del dirigente campesino José
Isabel Morales, “Chabelo”, por lo que este seguirá en prisión acusado
por el delito de homicidio.

Según un comunicado del Observatorio Permanente de los Derechos
Humanos, la defensa presentó una solicitud de revisión de medidas “el 9
de diciembre del 2013 y un mes después se realizó violentando
claramente la ley, ya que la misma establece que no puede exceder más
de 24 horas”.
La organización sostuvo que la revisión de medidas se solicitó para que
“Chabelo” sea escuchado en libertad, porque según la ley una persona no
puede estar privada de libertad más de 2 años sin sentencia, y el
imputado lleva 5 años 3 meses y 19 días preso en la Granja Penal de La
Ceiba. El juicio oral y público está programado para comenzar en este
mes.
A la audiencia, que culminó a eso de las 5:30 de la tarde de ayer, se
hicieron presentes defensores de Derechos Humanos, así como miembros de
organizaciones sociales, campesinas y familiares del imputado.
“Mi hijo es un hijo bien portado, si no fuera así yo no andaría con él
por aquí visitándolo y acompañándolo” argumentó su madre Ramona López.
Tras la decisión de los jueces, “Chabelo” fue enviado nuevamente a la
Granja Penal de El Porvenir. Familiares y representante de los DDHH
afirmaron que acudirán a la Corte Interamericana de Justicia porque
consideran que se están violentando los derechos del detenido.

Trujillo Court Refuses to Release Jose Isabel Morales Pending His New Trial

Radio Progreso has just reported that the court in Trujillo, Colon (Tribunal de Sentencia) has denied liberty to "Chabelo" Morales pending his new trial. The radio station reporter was with Chabelo's distraught family and other members of the region's campesino organizations and social justice movement outside the court where they had been waiting all day for a decision from the court in the face of the Suprement Court ruling that his original trial can't stand and he must be given a new trial. The Supreme Court also ruled that he should be free pending retrial but the power to make that decision was then given back to the regional court where the most powerful landowners in Honduras have declared war on the campesinos. Radio Progreso reported that Chabelo was being transported to La Ceiba to await his new trial in the prison there.
Chabelo is a member of the Campesino Movement of Aguan (MCA) and of the Central Nacional de los Trabajadores del Campo (CNTC). The CNTC currently has more than 3000 members who are either charged, detained or imprisoned on charges related to the agrarian conflict in a country in which most of the population is rural, living in extreme poverty, and without the land or resources to survive while a handful of the biggest landowners and agribusiness companies control most of the land, the courts, and the power.
